We take your privacy rights very seriously. Please read this privacy policy carefully as it contains important information on who we are and how and why we collect, store, use and share your personal information. It also explains your rights in relation to your personal information and how to contact us or supervisory authorities in the event you have a complaint.

We collect, use and are responsible for certain personal data about you. When we do so we are subject to the UK General Data Protection Regulation (UK GDPR). We are also subject to the EU General Data Protection Regulation (EU GDPR) in relation to goods and services we offer to individuals and our wider operations in the European Economic Area (EEA). The UK GDPR and EU GDPR give you specific rights in respect of your personal data when you are usually resident in those regions. While these specific rights may not be available to residents outside of these regions due to varying local data protection laws, ALLROCK endeavors to apply the same high standards of data protection, as mandated by UK and EU GDPR, across our operations globally. The contents of this privacy policy is also without prejudice to any jurisdiction specific terms which may apply to you depending on where you are usually resident and which may be issued by ALLROCK from time to time.

  • The ALLROCK Mobile Application (App) as available on the App Store and Google Play or Sonos. We also have a YouTube video and audio integration available within our App, the App Store, Google Play, Sonos and YouTube being collectively referred to as App Site(s). You can download or stream a copy of the App or our content via the appropriate App Site (as applicable) onto or via your mobile telephone or handheld device (Device).
  • Any of the services (Services) accessible through the App, www.allrock.live or other sites of ours (Services Sites). This policy sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. Our Services are not intended for children, and we do not knowingly collect data relating to children. Please read the following carefully to understand our practices regarding your personal data and how we will treat it.

By using our Services, you acknowledge that you accept the use of your personal information and the practices and policies outlined in this privacy policy. Please take the time to read this privacy policy and make sure you are content with our use and disclosure of your Personal Information. ALLROCK is a trading name of ETA Productions Ltd a UK based Company which is a subsidiary of US Company FanTracks Digital LLC. When we mention "ALLROCK", we are referring to the relevant company in the ALLROCK Group responsible for processing your data which will be clear to you when you use our Services. ALLROCK, a trading name of ETA Productions Ltd with registered office is at 303 The Pill Box 115 Coventry Road, London, England, E2 6GH and VAT number is GB 331 1606 47 is the controller responsible for the Services.

PERSONAL INFORMATION WE COLLECT ABOUT YOU

We may collect and use the following personal information about you:

  • your name and contact information, including email address and telephone number
  • location data, if you choose to give this to us
  • your subscription information and transaction data
  • data related to your Device
  • your contact history, purchase history and saved items
  • details of any feedback you give us by phone, email, post or via social media
  • information about the services we provide to you
  • your account details, such as username, login details
  • information from social media accounts you link to us, e.g. Facebook or integrations you activate via the App (such as YouTube)
  • Information about how you use our App, the Service Sites, IT, communication and other systems
  • your responses to surveys, competitions and promotions
  • information about how you use our services, the Service Sites and App, including your preferences and streaming of content.

Please note that we do not hold any data related to your billing information, transaction and payment card information. This is handled by third party providers (please see 'Who we share your personal information with' below).

This personal information is required to enable us to provide our streaming services to you. If you do not provide personal information when we ask for, it may delay or hinder us from providing our services to you.

HOW YOUR PERSONAL INFORMATION IS COLLECTED

We will collect and process the following data about you:

  • Information you give us. This is information (including identity, contact, and marketing and communications data) you consent to giving us about you by filling in forms on the App Site and the Services Sites (together Our Sites), or by corresponding with us (for example, by email or chat). It includes information you provide when you register to use the App Sites, download or register an App, subscribe to any of our services, search for an App or service, make an in-App purchase, share data via an App's social media functions, enter a competition, promotion or survey or other activities you carry out on our App and Service Sites, and when you report a problem with an App, our services, or any of Our Sites. If you contact us, we will keep a record of that correspondence.
  • Information we collect about you and your Device. Each time you visit one of Our Sites or use one of our Apps we will automatically collect personal data including device, content and usage data. We collect this data using cookies and other similar technologies. Please see our cookie policy below for further details.
  • Location Data.We may also use location services technology to determine your current location. Some of our location-enabled services require your personal data for the feature to work. If you wish to use the particular feature, you will be asked to consent to your data being used for this purpose. You can withdraw your consent at any time by disabling location data in Device your settings.
  • Information we receive from other sources including third parties and publicly available sources. We will receive personal data about you from various third parties including:
    - Device data from the App Sites; and
    - Contact, and transaction data from providers of technical, payment and delivery services such as Stripe and the App Sites.

We may use cookies and/or other tracking technologies to distinguish you from other users of the App, App Sites, the distribution platform of available content (App Store or Google Play, YouTube or Sonos) or Services Sites and to remember your preferences. This helps us to provide you with a good experience when you use the App or browse any of Our Sites and also allows us to improve the App and Our Sites. HOW AND WHY WE USE YOUR PERSONAL INFORMATION

Under data protection law, we can only use your personal information if we have a proper reason for doing so, e.g.:

  • to comply with our legal and regulatory obligations;
  • for the performance of our contract with you or to take steps at your request before entering into a contract;
  • for our legitimate interests or those of a third party; or
  • where you have given consent.

A legitimate interest is when we have a business or commercial reason to use your information, so long as this is not overridden by your own rights and interests.

We may also collect, use and share Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data could be derived from your personal data but is not considered personal data in law as this data will not directly or indirectly reveal your identity. For example, we may aggregate your usage of our Services to calculate the percentage of users accessing a specific App feature. However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this privacy policy.

We do not collect any special category personal information about you. Special category information (also known as sensitive information) includes personal information revealing racial or ethnic origin, political opinions, religious beliefs, philosophical beliefs or trade union membership, genetic and biometric data, data concerning health, sex life or sexual orientation. Nor do we collect any information about criminal convictions and offences. If this changes, we will only ever collect such special category information on the basis of your explicit consent.

Promotional communications

We may use your personal information to send you updates (by email, text message, telephone or post) about our services, including exclusive offers, promotions or new services or subscriptions.

We have a legitimate interest in processing your personal information for promotional purposes when you are an existing customer or subscriber (see above 'How and why we use your personal information '). This means we do not usually need your consent to send you promotional communications. However, where consent is needed, we will ask for this consent separately and clearly, for example when you tick the relevant boxes on signing up for our services or when you create your account. We will always treat your personal information with the utmost respect and never see or share it with other organisations outside of ALLROCK for marketing purposes. You have the right to opt out of receiving promotional communications at any time by:

  • using the 'unsubscribe ' link in emails or 'STOP ' number in texts
  • updating your marketing preferences within your account

We may ask you to confirm or update your marketing preferences if you instruct us to provide further services in the future, or if there are changes in the law, regulation, or the structure of our business.

Who we share your personal information with

We routinely share personal information with:

  • third parties we use to help deliver services to you, e.g. payment service providers, such as Stripe Inc., an online payment service provider, and the App Sites providers, providing us with access to their respective App Sites and functionalities to enable you to download our app, as well as cloud storage and hosting providers;
  • other third parties we use to help us run our business, e.g. marketing agencies or website hosts and app developers, lawyers, auditors and accountants;
  • third parties approved by you, e.g. social media sites you choose to link your account to.

We only allow our service providers to handle your personal information if we are satisfied that they take appropriate measures to protect your personal information. We also impose contractual obligations on service providers relating to ensure they can only use your personal information to provide services to us and to you.

We may also need to share some personal information with other parties, such as potential buyers of and/or investors in some or all of our business or during a re-structuring. Usually, information will be anonymised but this may not always be possible. The recipient of the information will be bound by confidentiality obligations.

Where your personal information is held

Information may be held at our offices, service providers, representatives and agents as described above (see above: 'Who we share your personal information with ').

Some of these third parties may be based outside the European Economic Area. For more information, including on how we safeguard your personal information when this occurs, see below: 'Transferring your personal information out of the EEA '.

How long your personal information will be kept

We will keep your personal information while you have an account or active subscription with us or for as long as we are providing services to you. Thereafter, we will keep your personal information for as long as is necessary:

  • to respond to any questions, complaints or claims made by you or on your behalf;
  • to show that we treated you fairly;
  • to keep records required by law.

We will not retain your personal information for longer than necessary for the purposes set out in this policy. Different retention periods apply for different types of personal information. By law we have to keep basic information about our customers for six years after they cease being customers for tax and legal purposes.

When it is no longer necessary to retain your personal information, we will delete or anonymise it. We may retain any anonymised and aggregated personal information for as long as we see fit, for the purposes of conducting data analytics or for ensuring improvement of our services indefinitely without further notice to you.

Transferring your personal information out of the EEA

To deliver services to you, it is sometimes necessary for us to share your personal information outside the European Economic Area (EEA), e.g.:

  • with our service providers located outside the UK or EEA; or
  • if you are based outside the UK or EEA.

Under data protection laws, we can only transfer your personal data to a country outside the UK or EEA where:

in the case of transfers subject to the UK GDPR, the UK government has decided the particular country ensures an adequate level of protection of personal data (known as an 'adequacy regulation ') further to Article 45 of the UK GDPR.

  • in the case of transfers subject to the EU GDPR, the European Commission has decided that the particular country ensures an adequate level of protection of personal data (known as an 'adequacy decision ') further to Article 45 of the EU GDPR.
  • there are appropriate safeguards in place, together with enforceable rights and effective legal remedies for you; or
  • a specific exception applies under relevant data protection law.

Where we transfer your personal data outside the UK or EEA, we do so on the basis of an adequacy regulation or decision respectively, or (where this is not available), by using legally-approved standard data protection clauses recognised or issued further to Article 46(2) of the UK GDPR and EU GDPR. In the event we cannot or choose not to continue to rely on either of those mechanisms at any time, we will not transfer your personal data outside the UK or EEA unless we can do so on the basis of an alternative mechanism or exception provided by UK or EU data protection law and reflected in an update to this policy.

Your rights

NOTICE TO United States RESIDENTS OF CALIFORNIA, NEVADA, VIRGINIA, AND OTHER STATES WITH SIMILAR LAWS

If you are a resident of California, Nevada, Virginia, or another state with similar privacy laws, the processing of certain personal data about you may be subject to the California Consumer Privacy Act (“CCPA”) and other applicable state privacy laws.

For the purposes of this section, “personal information” means “personal data”, “personal information” or similar terms under the applicable privacy laws of the state in which you reside. Please note that not all of the rights listed below are applicable to all users, and if you are not a resident of the applicable states, you may not be able to exercise these rights.

In particular, you may have the following rights, however, these rights are not absolute and in certain cases, we may decline your request as permitted by law.

Know The right to request that we disclose the personal information we collect, use, or disclose about you, and information about our data practices. As a California resident, you may request information about the categories of personal information that we have collected; the categories of sources from which we collected personal information; the business or commercial purpose for collecting, sharing and/or selling personal information; the categories of any personal information that we sold or disclosed for a business purpose; and the categories of any third parties with whom personal information was sold, shared or disclosed for a business purpose;
Access The right to request copies of your personal information that we have collected about you;
Correction The right to request that we correct any inaccurate personal information that we have collected about you;
Request Deletion The right to request that we delete personal information that we have collected from you;
Opt out The right to opt out of (i) tracking activities for targeted advertising purposes, (ii) sales of your personal information, and (iii) certain “profiling” as defined in applicable privacy laws, which may include automated processing to analyze or predict your interests or other behavior;
Non-Discrimination You have the right to not be discriminated against for exercising any of these rights. For example, if you exercise your rights, we will not deny you services, charge you different prices for services or provide you a different level or quality of services.

EXERCISING YOUR STATE PRIVACY RIGHTS

California residents can exercise the above rights themselves, or designate and authorized agent to make requests on their behalf. To either exercise your rights or to have an authorized agent (as applicable) request to do so, please email us at help@allrock.live and provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative, which may include: your name, user id, email, or billing address.

We may request additional documentation or information solely for the purpose of verifying your identity before completing your request. An authorized agent must have your signed permission to submit a request on your behalf or provide proof that they have power of attorney in accordance with California law. Before completing a request from an authorized agent, we may contact you directly to confirm your identity and/or to confirm that you 've given the agent permission to act on your behalf.

If you want to make a request but do not have an account with us, we will ask you for information that we consider necessary to verify your identity for security and to prevent fraud. This information may include name, contact information, and information related to your transaction or relationship with us, but the specific information requested may differ depending on the circumstances of your request for your security and to protect privacy rights. If we delete your personal information, we will both cause certain personal information about you to be permanently unrecoverable and also deidentify certain personal information.

KEEPING YOUR PERSONAL INFORMATION SECURE

All information you provide to us is stored on our secure servers. Any payment transactions carried out by our chosen third-party provider of payment processing services will be encrypted using Secured Sockets Layer technology or equivalent technology. Where we have given you (or where you have chosen) a password that enables you to access certain parts of Our Sites, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

Once we have received your information, we will use strict procedures and security features to try to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way.

We have appropriate security measures to prevent personal information from being accidentally lost or used or accessed unlawfully. We limit access to your personal information to those who have a genuine business need to access it. Those processing your information will do so only in an authorised manner and are subject to a duty of confidentiality. We also have procedures in place to deal with any suspected data security breach. We will notify you and any applicable regulator of a suspected data security breach where we are legally required to do so.

The UK GDPR and EU GDPR also gives you right to lodge a complaint with a supervisory authority, in particular in the UK or EEA state where you work, normally live or where any alleged infringement of data protection laws occurred. THE SERVICE SITES AND APP

Throughout the Service Sites and App, we may link to other websites owned and operated by certain trusted third parties, for example, our partner networks, advertisers and affiliates and to make additional products and services available to you (such as YouTube video and audio) or where you have allowed the placement of cookies to follow your browsing movements within a social media account, for example on Facebook. These other third-party websites and apps and integrations may also use cookies or similar technologies in accordance with their own separate policies. We do not accept any responsibility or liability for these policies or for any personal data that may be collected through these websites or services. For privacy information relating to these other third-party websites and apps, please consult their policies as appropriate before you submit any personal data to these websites or use these services.

COOKIES Policy

A cookie is a small text file which is placed onto your device (e.g. computer, smartphone or other electronic device) when you use the Service Sites and App.

We only use essential cookies on the Service Sites and App, which are strictly required to enable the Service Sites and App to function properly. This means that we do not need to obtain your prior consent to use these essential cookies.

Please note that if we do use other types of cookies for which your consent is required, we will update you via this page, and/or via a cookies banner which will be placed on the Service Sites and App .

How to turn off all cookies and consequences of doing so

If you do not want us to use essential cookies and do not wish cookies to apply to your overall use of the internet, you may be able to change your browser or device settings so that cookies (including those which are essential to the services requested) are not accepted. We keep our privacy policy under regular review.

This version was last updated on 18 November 2023. It may change and if it does, these changes will be posted on this page and, where appropriate, notified to you by SMS, by email or when you next start the App or log onto one of the Services Sites. The new policy may be displayed on-screen and you may be required to read and accept the changes to continue your use of the App or the services. It is important that the personal data we hold about you is accurate and current. Please keep us informed if your personal data changes during our relationship with you.
